1. Contract Overview

1.1 AlphaSunglasses is a trading name of AlphaOmega Frame Repairs Ltd, Unit 6 Macon Court, Herald Drive, Crewe, CW1 6EA.

1.2 A legally binding contract between AlphaSunglasses and the customer will be created once the ordered goods are dispatched.

1.3 In accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2014 customers have the right to cancel an order within fourteen working days. This period runs either from the day of delivery in the case of ordered goods or from the day after the contract was concluded in the case of services.

1.4 Further to these statutory regulations AlphaSunglasses offers the right to return unwanted or faulty goods within 30 days. Sale items are exempt from the 30-day returns — see Returns below.

2. Prices

2.1 The prices payable for goods ordered by the customer are as set out on the AlphaSunglasses website and include UK VAT at the current legal rate.

2.2 Customers may be required to pay extra for package and postage.

2.3 EU member countries as well as other countries, states or territories are obliged to pay the UK VAT rate on their purchases.

2.4 Prices are set at GB Pound Sterling rates. Prices in other currencies may fluctuate relative to the exchange rate at the time of dispatch.

3. Deliveries

3.1 Delivery charges for ordered goods are the same as those set out on the AlphaSunglasses website.

3.2 AlphaSunglasses aims to deliver all mainland UK orders within one working day. Non-mainland deliveries usually take one to three working days but delivery may take longer in exceptional circumstances. For any amendments to the delivery address, Alpha Sunglasses must be notified by email prior to the processing of the order.

3.3 For UK deliveries goods cannot be considered as missing in the post until 15 working days after the day of posting and Alpha Sunglasses will not re-send orders before this 15 working day period.

3.4 International orders are normally delivered within seven working days but can take up to 28 days or longer. For international deliveries goods cannot be considered as missing in the post until 30 working days after the day of posting and AlphaSunglasses will not re-send orders before this 30 working day period.

3.5 All international orders are sent with duties and taxes to be paid by the recipient. Duties will be charged by the importing country based on current laws governing imports. In the event of a product return from a UK VAT exempt country, state or territory the customer will be responsible for any taxes and/or surcharges incurred.

3.6 For delivery to remote locations AlphaSunglasses may contact the customer about shipping options before the order is dispatched. It may not be possible for Alpha Sunglasses to deliver to particular locations.

3.7 Most goods will require a signature on receipt of delivery and the customer may need to contact the delivery company in the event of a problem. AlphaSunglasses cannot be held responsible for failed deliveries due to an incorrect address or unavailability of a signature on delivery. If goods are returned to us for these reasons AlphaSunglasses reserves the right to re-charge for postage and handling, or deduct the cost if a refund is requested.

3.8 If delivered goods have been damaged in transit, please ensure that the goods are signed as 'damaged' or 'unchecked'. Whether the customer receives the goods or refuses the delivery please contact Alpha Sunglasses as outlined in the Returns section.

3.9 Upon delivery of the order the customer becomes the owner of the goods and AlphaSunglasses will not be held liable for their loss, damage or destruction.

4. Cancellations

4.1 Customers can cancel their order at any time before the goods are dispatched. There are a number of ways to cancel an order.

4.2 AlphaSunglasses is not obliged to accept payments and reserves the right to cancel an order at any point before dispatch.

4.3 AlphaSunglasses reserves the right to cancel a contract with any customer if:
AlphaSunglasses has insufficient stock to deliver the ordered goods.
AlphaSunglasses is unable to deliver to a customer's address
The ordered goods have been listed at an incorrect price on the website
Payment and/or delivery details cannot be verified.
The order is considered fraudulent or in any other way vexatious.

4.4 If AlphaSunglasses does cancel a contract, the customer will be notified by e-mail within a reasonable time and the customer's account will be credited with any sum deducted via the original method of payment as soon as reasonably possible but, in any event, within 14 days of the order being cancelled. Alpha Sunglasses is not be obliged to offer any additional compensation for disappointment suffered as a result of the cancellation.

5. Returns

5.1 AlphaSunglasses offers a free returns option for purchased goods. If a customer chooses to use a paid service, return postage cannot be refunded.

5.2 If a customer is dissatisfied with ordered goods and wishes to return those goods before cancelling the contract there are a number of ways to do so:

5.3 The customer must return the goods to the AlphaSunglasses address at their own cost and risk within a reasonable time. In the event of a product return from a UK VAT-exempt country, state or territory the customer is responsible for any taxes and/or surcharges incurred.

5.4 Goods should be returned in the packaging in which they were received and must include any branded material posted with the original delivery, for example, cases, cloths and warranty.

5.5 Please do not return goods in paper envelopes, paper bags (such as Jiffy envelopes) or any other flimsy containers as these may not offer proper protection when in transit. AlphaSunglasses reserve the right to return incoming goods damaged in transit and the said goods shall remain the responsibility of the customer.

5.6 If returned goods are received by AlphaSunglasses in the same condition in which they were dispatched any sum debited to the customer from the original payment will be credited to the customer's account as soon as reasonably possible and in any event within 14 days of being received.

5.7 If delivered goods are not returned or the costs of delivery have not been paid AlphaSunglasses will be entitled to deduct the direct costs of recovering the goods from the customer's account.

5.8 If the goods are not returned in the condition they were sent, AlphaSunglasses reserves the right to charge the cost of recovering the goods directly to the customer.

6. Liability

6.1 If the delivered goods are not what the customer ordered or are damaged or defective or if the delivery is of an incorrect quantity, AlphaSunglasses shall have no liability unless notified of the problem immediately, by email, telephone, or in writing at the company's contact address, and in any event within 10 working days of the delivery of the goods in question.

6.2 If the customer has not received the ordered goods within 30 days of the date on which they were ordered, Alpha Sunglasses shall have no liability unless notified, by email, by telephone or in writing at the company's contact address within 40 days of the date on which the goods were ordered.

6.3 If notified of a problem a outlined above, AlphaSunglasses will have an obligation only to either:

  • Make good any shortage or non-delivery
  • Replace or repair any goods that are damaged or defective
  • Refund the amount paid for the goods in question in whatever way Alpha Sunglasses chooses

6.4 Save as precluded by law, AlphaSunglasses will not be liable for any indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill) howsoever arising out of any problem notified under this condition and shall have no liability to pay any money by way of compensation other than to refund the amount paid for the goods in question.

6.7 The customer must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase goods from the AlphaSunglasses website. The importation or exportation of certain of goods may be prohibited by certain national laws. Alpha Sunglasses makes no representation and accepts no liability in respect of the export or import of the goods purchased.

6.8 Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights the customer might have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to the customer for any death or personal injury resulting from negligence by AlphaSunglasses.

7. Payments

7.1 Payments can be made through credit/debit card using Secure Trading or PayPal via a requested payment invoice. AlphaSunglasses also accepts bank transfers, payments by cheque and cash.

7.2 Debit and credit card payments will be subject to AVS checks. If payments are not confirmed by the card issuer or fail these checks, dispatch may be delayed.

7.3 If payment details are different to the billing address the order may be subject to enhanced security checks and this may delay dispatch.
